Services
1.1 Photography Services: Nicolas Fernandez Photography offers professional photography services, including but not limited to portrait photography, event photography, product photography, and photo editing services. The specific details and terms for each service will be discussed and agreed upon with the client before the commencement of the project.

1.2 Client Responsibilities: As a client, you agree to provide accurate and complete information about your photography needs and requirements. You also agree to cooperate with Nicolas Fernandez Photography during the project, including but not limited to providing access to the venue, necessary permissions, and timely communication.

Payment and Cancellation
2.1 Pricing: The pricing for our services will be discussed and agreed upon with the client prior to the project. The agreed-upon pricing may include fees for photography services, prints, digital copies, additional editing, and any other relevant items.

2.2 Payment Terms: Unless otherwise specified, a full deposit may be required to confirm your booking. Payment can be made through the accepted methods as specified by Nicolas Fernandez Photography.

2.3 Cancellation Policy: In the event of cancellation by the client, any deposit or payment made may be subject to a cancellation fee or non-refundable depending on the circumstances and any costs already incurred by Nicolas Fernandez Photography. The specific cancellation terms will be communicated to the client during the booking process.

Intellectual Property
3.1 Ownership: Nicolas Fernandez Photography retains all intellectual property rights to the photographs and other creative works produced as part of the services, including copyrights and any other applicable rights. The client is granted a limited, non-exclusive, and non-transferable license to use the photographs for personal, non-commercial purposes, unless otherwise agreed upon in writing.

3.2 Usage and Reproduction: The client agrees not to use the photographs in any manner that violates copyright laws or infringes upon the rights of Nicolas Fernandez Photography or any other third party. Any additional usage or reproduction rights beyond the scope of the license granted must be agreed upon in writing and may be subject to additional fees.

Limitation of Liability
4.1 Disclaimer: Nicolas Fernandez Photography strives to provide high-quality services; however, we do not guarantee the results or the suitability of the photographs for any specific purpose. We are not liable for any dissatisfaction or damages arising from the client's use of the photographs or services.

4.2 Indemnification: The client agrees to indemnify and hold Nicolas Fernandez Photography and its affiliates, employees, and agents harmless from any claims, losses, liabilities, damages, or expenses arising out of the client's use of our services or violation of these Terms.

Governing Law and Dispute Resolution
5.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of Florida, without regard to its conflict of laws principles.

5.2 Dispute Resolution: Any disputes arising out of or relating to these Terms or the services provided by Nicolas Fernandez Photography shall be resolved through good-faith negotiations between the parties. If the parties are unable to reach a resolution, the dispute may be submitted to binding arbitration in accordance with the rules of Florida.

Modifications and Termination
6.1 Modifications: Nicolas Fernandez Photography reserves the right to modify or update these Terms at any time without prior notice. It is your responsibility to review these Terms periodically for any changes.

6.2 Termination: Nicolas Fernandez Photography may terminate or suspend your access to our services at any time, with or without cause, and without liability. Upon termination, any rights granted to you under these Terms will cease.

Severability and Entire Agreement
7.1 Severability: If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

7.2 Entire Agreement: These Terms constitute the entire agreement between you and Nicolas Fernandez Photography regarding the services provided and supersede any prior agreements, understandings, or negotiations, whether written or oral.
